DMCA takedown policy
Creator Commerce Ltd respects the intellectual-property rights of others and expects users of Got.Fans to do the same. We respond to valid notices under the United States Digital Millennium Copyright Act and may also act under other applicable copyright laws.
Reporting copyright infringement
If you believe material available through Got.Fans infringes copyright, send a written notice containing:
- a physical or electronic signature of the copyright owner or a person authorised to act for them;
- identification of the copyrighted work, or a representative list where one notice covers multiple works;
- identification of the allegedly infringing material and information reasonably sufficient for us to locate it, including the Got.Fans URL;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent or the law; and
- a statement that the notice is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner.
Where to send a notice
Email notices to hey@got.fans with the subject line 'DMCA Notice'. You may also write to our Copyright Agent at Creator Commerce Ltd, Digital World Centre, 1 Lowry Plaza, Salford Quays, Manchester, England M50 3UB.
Incomplete notices may delay our response. We may forward a notice, including contact information, to the person responsible for the material or to a transparency service where lawful.
Counter-notification
If material you submitted was removed or disabled because of mistake or misidentification, you may send a counter-notification containing:
- your physical or electronic signature;
- identification of the material removed or disabled and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled by mistake or misidentification;
- your name, address and telephone number; and
- a statement consenting to the jurisdiction of the appropriate United States Federal District Court and accepting service of process from the original complainant, as required by the DMCA.
What happens next
After receiving a valid counter-notification, we may send it to the original complainant. We may restore the material after the period specified by law unless the complainant tells us they have filed a court action seeking to restrain the alleged infringement.
Knowingly making a material misrepresentation in a notice or counter-notice may result in liability under section 512(f) of the DMCA or other law. Consider obtaining legal advice before submitting one.
Repeat infringement and other rights
We may suspend or terminate accounts and remove or restrict profiles in appropriate circumstances involving repeated infringement. We may also address trademark, privacy, publicity or other rights complaints under our Content Policy, even when the DMCA does not apply.
