1. Introduction and acceptance
These Terms of Service are between you and Creator Commerce Ltd ("Got.Fans", "we", "our" or "us") and govern your use of got.fans and related services, including the public creator directory, search, reviews, saved profiles, creator claims, profile management, promotions and subscription plans.
By accessing or using Got.Fans, you agree to these Terms, our Privacy Policy, Content Policy and DMCA Policy. If you do not agree, do not use the service. You must be at least 18 and have reached the age of majority where you live.
2. What Got.Fans provides
Got.Fans helps people discover creators and reach their official pages on independent platforms. We may show profile information, categories, locations, reviews, public links, prices and offers, including information supplied by creators and information observed on public pages.
Got.Fans is not the creator, seller or operator of content or subscriptions offered on third-party platforms. We do not control those platforms, their content, availability, pricing, billing, refunds or conduct. A link or verified badge is not an endorsement or guarantee.
3. Accounts and security
Some features may require an account. You must provide accurate information, keep access credentials secure and notify us promptly of suspected unauthorised use. You are responsible for activity through your account unless caused by our failure to use reasonable care.
We may refuse, suspend or close an account where reasonably necessary for security, legal compliance or enforcement of these Terms.
4. Creator profiles, claims and agencies
A public profile may exist before it is claimed. A creator or authorised representative may claim an existing profile or create one, subject to verification. You must not claim or manage a profile without authority.
Creators and agencies must keep profile information and official links accurate, disclose relevant representation and comply with applicable laws and third-party platform rules. An agency is responsible for ensuring it has continuing authority for every profile it manages.
We may distinguish between information verified by a creator and information found or observed publicly. We may correct, label, restrict or remove information that is inaccurate, unsafe, unlawful or misleading.
5. User submissions and reviews
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, display and distribute that content as needed to operate, promote and improve Got.Fans. This licence ends when the content is deleted, except for cached copies, legal records and material already shared as part of the service.
You represent that you have the rights and permissions needed for anything you submit and that it complies with our Content Policy. Reviews must reflect a genuine experience. We may moderate, reject, remove or restrict submissions, but we are not obliged to monitor everything before publication.
6. Acceptable use
You must not:
- use Got.Fans unlawfully or in breach of our Content Policy;
- exploit or endanger a minor or facilitate non-consensual, abusive or illegal conduct;
- impersonate another person, submit a false claim or misrepresent authority;
- publish private data, defamatory material, malicious falsehoods or infringing content;
- send spam, distribute malware, evade access controls or interfere with security;
- scrape, copy or systematically extract the directory without written permission;
- manipulate reviews, rankings, traffic, clicks, promotions or verification; or
- use Got.Fans in a way that damages the service or prevents others from using it.
7. Prices, offers and promoted placements
Third-party prices, free trials and deals may change without notice. Information shown by Got.Fans may be delayed or incomplete. Always confirm the final price, renewal terms and availability on the official destination before purchasing.
Paid or promoted placements will be labelled. We may charge creators, agencies or advertisers for plans and promotion tools. The price, billing period, cancellation terms and any refund rights for a paid Got.Fans service will be shown before purchase. Unless stated otherwise, fees are non-refundable to the extent permitted by law.
8. Intellectual property
Got.Fans, its design, software, branding and original materials are owned by us or our licensors and protected by intellectual-property laws. No ownership is transferred to you. You may use the service for its intended personal or authorised business purpose, but may not reproduce, resell or create a competing database from it without permission.
Creator names, images, trademarks and third-party platform marks belong to their respective owners. Copyright complaints are handled under our DMCA Policy.
9. Privacy and profile control
Our Privacy Policy explains how we process personal data. Creators and authorised representatives may request correction, claim, restriction or removal of a profile. We may verify identity and retain a limited suppression record to respect an opt-out and meet legal or safety obligations.
10. Service availability and changes
We may add, change, suspend or discontinue features. We do not guarantee uninterrupted operation, permanent storage, any level of traffic, search position, earnings, conversions or availability of a creator or third-party page. We may update these Terms by posting a revised version. Continued use after the effective date means you accept the revision.
11. Disclaimers and limitation of liability
Got.Fans is provided on an 'as is' and 'as available' basis. To the extent permitted by law, we exclude implied warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, lost profits, lost data, third-party conduct or transactions completed on external platforms. Our total liability arising from Got.Fans will not exceed the greater of GBP 100 or the amount you paid us in the 12 months before the event giving rise to the claim. Nothing excludes liability that cannot lawfully be excluded.
12. Indemnity
To the extent permitted by law, you will indemnify and hold harmless Got.Fans, its group companies, officers and staff from claims, losses and reasonable costs arising from your unlawful use, your submissions, your profile management, your breach of these Terms or your infringement of another person's rights.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have non-exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
Before filing a claim, please contact us and allow a reasonable opportunity to resolve the concern informally.
14. General terms
If part of these Terms is unenforceable, the remainder remains effective. A failure to enforce a provision is not a waiver. You may not transfer your rights without our consent; we may transfer these Terms as part of a reorganisation, financing or sale. These Terms and incorporated policies form the entire agreement about Got.Fans.
